After the complainant asked Morad to move away, Morad knocked off his hat, sprayed gas toward his eyes, and took the Rolex watch he was wearing.
It was further alleged that when the complainant, who was dazed, stepped onto the road, Morad pushed him toward the station wall, ripped a gold and diamond necklace from his neck, and fled the scene.
The defendant's version: during his interrogation, Morad denied taking the complainant's property and claimed that only an argument had taken place between the two. He denied the main allegation in the indictment, that the incident included a robbery of the watch and the necklace.
In the arrest petition filed alongside the indictment, the state pointed to three prior convictions of Morad and prison sentences he had served in the past
In the sentence, the court weighed the severity of the offense alongside the complex personal circumstances of the defendant, and determined the sentence of actual imprisonment along with compensation for the victim of the offense.
